Workmanship and Material Guarantee |
|
As part of the consideration for the contract identified below, Michael
Electric hereby guarantees to the customer or owner of the premises, for a period of one
(1) year from the date of completion, that the work performed under said contract was performed
in a workmanlike manner and that the material purchased and installed by
Michael Electric there under was, when installed, free of inherent
manufacturing or mechanical defect, all to the extent and on the conditions
herein specifically set forth, that is:

1. |
Michael Electric shall maintain a database and related files of equipment
installed for each system contracted and installed through Michael Electric
consisting of:
a. As built drawings and
diagrams of each cabling system;
b. Close-out
documents (at customer's option Operating Manuals and Technical
Specification);
c. Each System
Manufacturer Warranty data;
d. Warranties'
Tickler File of the dos and don'ts and expiration and optional renew dates;
e. Mandatory and
Optional Maintenance Schedules followed up with a 30-day lead-time notice to
the customer when each is due;
f. Log of events
detailing date of each call made to the respective manufacturer, programmer,
or vendor reporting and requesting service on any failed system and the
event final resolution, provided:
(1).
The customer notifies Michael Electric by phone, fax,
or e-mail within twenty-four (24) hours of the time of the failure of the
system has become apparent.
(2). No person, firm, or corporation other than
Michael Electric or his system subcontractor has, during and since the
completion of the work performed or attempted to perform any of the work
included in said contract or repaired or attempted to repair any of the work
performed by Michael Electric there under; in which case:

Michael Electric shall
manage and coordinate the
repair of the failing system by notifying the parties responsible and follow
up the event until the system is back up and running as intended;
Upon notification from the
system's technician that the cable or any cabling device installed by
Michael Electric has tested defective, Michael Electric, at no cost to the
customer, shall repair or replace that cable or device within 8 hours of
that notification. |

Workmanship and Material Guarantee |

4. |
Michael
Electric shall replace, without cost of charge to the owner for either labor
or material, such wiring and electrical apparatus installed under
said contract as may become defective or unserviceable within the period of
the guarantee by reason of any failure of Michael Electric in performing the
work in workmanlike manner or by reason of inherent manufacturing or
mechanical defect in any material purchased and installed by
Michael Electric provided:
a. The customer notifies Michael Electric in writing within ten (10)
days of the date of such failure any failure of the system affected
within 24 hours of the date and time such failure has become apparent;
b. Their shall be no responsibility on Michael Electric to replace items
such as equipment that is furnished by others;
c. No person, firm, or corporation other than Michael Electric has, during
and since the completion of the work performed or attempted to perform any
of the work included in said contract or repaired or attempted to repair any
of the work performed by Michael Electric there under;
e. The defect or failure was not caused or affected by the improper use or
operation of the facilities installed under said contract.

Michael Electric liability shall be fixed by the terms hereof and
this express guarantee excludes and supersedes all implied guarantees or
warranties.
This guarantee shall pass with the title of the premises to the new
owner thereof. |
